Daniel’s areas of practice include fraud and asset recovery, commercial disputes, and white-collar investigations. Prior to joining PDLegal LLC, Daniel practiced at one of the largest law firms in Singapore. Daniel’s litigation experience includes assisting in numerous high-value cross-border disputes which went before the Supreme Court of Singapore, Singapore International Arbitration Centre, and Singapore International Commercial Court. These disputes include, among others, general contractual disputes, loan enforcement actions, shareholder disputes, employment disputes, and fraud. Daniel has also volunteered as a pro-bono defence counsel for numerous cases under the Criminal Legal Aid Scheme. 

 

Separately, Daniel also assisted various multinational companies and banks in Singapore with their internal investigations into misconduct, corruption and employer retaliation.

Commercial and civil disputes

  • Involved in enforcing a high-value loan on behalf of a bank in the High Court for a sum totalling more than SGD100 million. The loan was secured by numerous securities across multiple asset classes, including share pledges, ship mortgages, and real estate. The scope of work involved devising a holistic enforcement strategy to maximise the value recovered, due to the complex structure of the loan and numerous cross-default clauses.  
  • Involved in litigating a complex multimillion dollar inheritance dispute on behalf of a beneficiary to a will in the High Court which spanned multiple lawsuits across areas of law including, among others, equities, trusts, company law (in particular minority shareholder rights) and probate law.
  • Involved in instituting cross-border debt recovery / breach of trust proceedings in the High Court against the directors of a foreign company for sums exceeding USD80 million.
  • Involved in instituting complex cross-border asset recovery proceedings in the High Court against a general manager who had fraudulently misappropriated some IDR 800 billion (about SGD82 million) from a company, inter alia via hundreds of fictitious work orders and payments to shell companies. Also assisted as instructing counsel for the claimant company’s Indonesian lawyers in the same matter. At the interlocutory stage, the matter canvassed novel legal arguments in respect of the High Court’s jurisdiction to grant a Mareva injunction against a foreign defendant whose only connection to Singapore was his having property in Singapore. The Court held that the mere existence of the defendant’s property in Singapore was, on its own, insufficient to give the Court jurisdiction and power to grant a Mareva injunction against him in aid of foreign court proceedings. 
  • Involved in the successful defence of a government agency in an SIAC arbitration brought by an unsuccessful tenderer against the agency.
  • Involved in bringing a successful minority oppression claim before the SICC, resulting in the court-ordered buyout of the claimant’s minority stake in a multi-million-dollar Singapore company.

White-collar investigations

  • Involved in the conduct of two (unrelated) investigations into market misconduct allegations against relationship managers at the local branches of two international banks.
  • Involved in the conduct of an investigation into employer retaliation allegations made by an employee against the local branch of an international bank.
  • Involved in the conduct of an investigation into allegations of corruption by a general manager of the local subsidiary of a multi-national company.
