PDLegal recently acted for KSE Electricals Pte Ltd (India) (“KSE”) in successfully defending an application before the Singapore High Court to set aside an international arbitral award arising from a cross-border power infrastructure supply contract.
The dispute arose from a contract for the supply of electrical distribution infrastructure to the Bangladesh Rural Electrification Board (BREB). The application raised complex issues concerning the tribunal’s alleged failure to consider essential issues, the parties’ agreed arbitral procedure relating to further joint testing, and allegations of breach of natural justice.
Following a one-day hearing, the Singapore High Court dismissed the application in its entirety, upholding the arbitral award in KSE’s favour. The award relates to a dispute with a value of more than US$7 million.
